21/10/2025 - Noisy neighbour found guilty of repeated noise nuisance

Luton Council has successfully prosecuted a council tenant for breaching a noise abatement notice.

Marcus Hamilton, of 1 Ickley Close, Luton, was the subject of numerous complaints for playing loud music at all hours. Despite repeated warnings, he continued to cause excessive noise which council officers assessed and determined to be a statutory nuisance. 

An abatement notice was issued which Mr Hamilton did not comply with, leading officers to obtain a warrant and seize his sound equipment. He later purchased new equipment and resumed playing loud music. 

Mr Hamilton appeared at Luton Magistrates’ Court on 29 September 2025, where he was found guilty of all 13 breaches of the notice. He was fined £500, ordered to pay a victim surcharge of £200 and £500 in costs, making a total of £1,200.

Councillor Maria Lovell, portfolio holder for community safety, said: “While some level of noise is to be expected in a busy town, there is a clear difference between normal day-to-day living and behaviour that deliberately disrupts others. Everyone deserves to feel comfortable and at peace in their own home. When individuals choose to ignore repeated warnings and show no regard for their neighbours, the council will take firm action to protect our residents and uphold the standards of our communities.”

The council has also obtained a possession order against Mr Hamilton for breach of his tenancy agreement.
