06/04/2023 - Luton resident prosecuted for part in fly-tipping

Luton Magistrates Court has found Moazam Mumtaz of Westbourne Road guilty of breaching Section 34 of the Environmental Protection Act 1990.

The ruling came on 31 March 2023, after an investigation into a fly-tip located at Power Court, Luton.

Luton Council’s fly-tipping response crews discovered evidence linking Mumtaz to the fly tip, which was investigated in January 2022. It was determined that Mumtaz had failed to undertake the proper requirements for a householder when transferring waste control. As a result, he was issued with a fixed penalty notice of £400 for a breach of residential duty of care.

However, the fixed penalty notice went unpaid, and the case was referred to prosecution. The fines issued to Mumtaz totalled £483.

Fly-tipping is defined as rubbish that is dumped illegally onto a street, private or public land. As part of its ‘Wall of Shame’ campaign, Luton Council posts instances of fly-tipping on its website in an effort to track down the offenders. Residents are invited to help identify offenders on the website and through regular appeals on social media. The Wall of Shame can be found at https://m.luton.gov.uk/Page/Show/Community_and_living/crime-and-community-safety/keeplutontidy/Pages/Wall-of-Shame.aspx?redirectToMobile=True

Roger Kirk, Service Director for Property, Infrastructure and Neighbourhood Services at Luton Council, said “This prosecution demonstrates that we take environmental protection seriously and will take action against those who fail to follow the correct procedures for waste disposal. We encourage all residents to take their responsibility for waste disposal seriously.”

“Luton Council has a zero-tolerance attitude towards any instance of fly-tipping because nobody wants to live in a town where it is rife. I encourage anyone who witnesses instances of fly-tipping to report it to the council immediately.”

Fly-tipping can be reported to Luton Council anonymously at https://m.luton.gov.uk/Page/Show/Environment/Pages/Report-a-street-care-or-cleaning-problem.aspx.
