Modify the definitive map to record the footpath No. 159 Langley Place, Luton
In developing proposals to convert Unit 4 of the Telmere Industrial Estate in the New Town area of Luton to 12 bedsits, which were approved by the Council under Part 3 Class O of the Town & Country Planning (General Permitted Development) Order 2015, the owner provided the Council with evidence of an historic path known as Langley Place which ran alongside the Sugar Loaf public house. Luton Borough Council carried out research of its own and accordingly made a Definitive Map Modification Order to: Modify the Definitive Map to record Footpath No. 159 Langley Place, Luton as running from New Town Street to the rear boundary with Unit 4 of the Telmere Industrial Estate.
This order is made by Luton Council (“the authority”) under Section 53(2)(b) of the Wildlife and Countryside Act 1981 (“the Act”) because it appears to the Authority that the DMS for the excluded fully developed area of Luton require modification in consequence of the occurrence of an event specified in section 53(3)(c)(i) of the Act namely:
(c) the discovery by the surveying authority of evidence which (when considered with all other relevant evidence available to them) shows:
(i) that a right of way which is not shown in the map and statement subsists or is reasonably alleged to subsist over land in the area to which the map relates, being a right of way such that the land over which the right subsists is a public path.
The authority hereby order that:
- for the purposes of this order the relevant date is 15 January 2020
- the DMS for the former excluded fully developed area of Luton shall be modified as described in part I and part II of the schedule and shown on the map attached to this order
- this order shall take effect on the date it is confirmed and may be cited as the Luton Council, footpath No 159 (Langley Place, Luton) DMS modification order 2020.
The foregoing order is hereby confirmed, 11 October 2021, Catherine Beeby, an inspector appointed by The Secretary of State for Environment, Food and Rural Affairs.

The length of footpath no 159 (Langley Place), Luton to be added is marked by a black dashed line on the map and extends from the back of the footway at New Town Street, Luton at Ordnance Survey grid reference (OS GR) 509380 220608.1 (point A on the order map) and runs in a generally south-south-westerly direction for approximately 10.2 metres to the rear boundary of unit 4 on the Telmere Industrial Estate, Luton at OS GR 509375.6 220598.9 (point B on the order map).
The footpath varies in width between 1.75 and 2.00 metres and partly runs across the top of a metal door that provides access to the cellar of the Public House.
