A Public Spaces Protection Order (formally known as a ‘gating order’ until 20/10/14) is a way of restricting access to rights of way, to reduce persistent crime and anti-social behaviour, which is a priority for us.
Public Spaces Protection Order (PSPO) replaces a number of orders including Designated Public Place Order (DPPO), Dog Control Orders and Gating Orders.
The test is – ‘Behaviour has to be likely to or has had a detrimental effect on the quality of life of those in the locality; be persistent, unreasonable and justifies the imposed notice’.
Prior to the new ASB Tools and powers being introduced, we have adopted the use of these orders, which do not remove any underlying highway status and will be reviewed every 12 months. Decisions on PSPO’s come under the authority of the Cabinet Member (Neighbourhoods and Community Safety). Prior to a PSPO coming into effect, a 28 day PSPO Notice is issued, allowing representations from interested parties.
Any of the current orders - downloadable below - in place, will transfer to a PSPO on 20/10/17.
