Fireworks
We appreciate and understand the frustrations of residents with regards nuisance fireworks. They are extremely inconsiderate towards residents in an area far beyond their point of release.
It is against the law to let them off in “Night hours” only with exceptions are:
- 5 November
- New Year
- Chinese New Year
- Diwali displays
“Night hours” are defined as:
- beginning at 11 pm on the first day of the Chinese New Year and ending at 1 am the following day;
- beginning at 11 pm on 5 November and ending at 12 am the following day;
- beginning at 11 pm on the day of Diwali and ending at 1 am the following day; or
- beginning at 11 pm on 31 December and ending at 1 am the following day.
Punishment for letting off fireworks outside of these hours includes very heavy fines (there is no upper limit), an on-the-spot fine of £90, or even up to a six months' jail sentence.
Responsibilities of the council and police
Unfortunately, as a council our hands are tied as it is a matter of the law and therefore it is for the police to act on reports.
Residents should report the illegal use of fireworks, to Bedfordshire police online.
The police are responsible for:
- fireworks being let off during “Night Hours”
- fireworks being let off on the street or other public place
- minors in possession of fireworks
The council is responsible for:
- sale of fireworks to minors
- product safety issues in relation to fireworks – (note: this is about the compliance of the product to safety standards, not unsafe use)
- licensing the sale of fireworks
Police and council:
- noise caused by firework let off from premises other than during night hours – council and police (under different legislation)
